PRINCIPLES OF PROCESSING CLIENTS' PERSONAL DATA IN ACCORDANCE WITH GDPR

The purpose of this policy is to process clients' personal data in accordance with the GDPR (hereinafter referred to as the "policy") issued by the entrepreneur Aliaksandr Matsveyeu registered in the Republic of Lithuania under number 1204151 (hereinafter also referred to as "Aliaksandr Matsveyeu"), is to provide information on what personal data (hereinafter referred to as "data") Aliaksandr Matsveyeu as an administrator processes about individuals when selling goods in Aliaksandr Matsveyeu brand stores, online store, when visiting websites managed by Aliaksandr Matsveyeu, and in contacts with potential clients. In addition, the principles specify for what purposes and for what period Aliaksandr Matsveyeu processes this personal data in accordance with applicable law, to whom and for what reason it may transfer it, as well as information about the rights that individuals have in connection with the processing of their personal data.

These rules are valid from 25.05.2018 and are issued in accordance with Regulation (EU) 2016/679 on the protection of individuals with regard to the processing of personal data (hereinafter referred to as the "Regulation" or "GDPR") in order to ensure the information duty of Aliaksandr Matsveyeu as a personal data controller in accordance with Art. 13 GDPR.

This policy applies to the processing of personal data of Aliaksandr Matsveyeu customers, users of Aliaksandr Matsveyeu services, those interested in Aliaksandr Matsveyeu products and visitors to websites operated by Aliaksandr Matsveyeu, always within the scope of personal data protection in accordance with the GDPR, corresponding to their position in relation to Aliaksandr Matsveyeu.

3.2. Other data is processed on the basis of your consent, which we receive from you when using our services

3) Records of behavior on websites operated by Aliaksandr Matsveyeu, obtained from cookies if cookies are enabled in the web browser. The records are processed to improve the operation of websites operated by Aliaksandr Matsveyeu and online advertising)

3.3 Data on purchased goods and payment behavior

5. PROVISION OF PERSONAL DATA

Provision of personal data necessary for the performance of the contract, fulfillment of the legal obligations of "Aliaksandr Matsveyeu" and protection of the legitimate interests of "Aliaksandr Matsveyeu" is mandatory. Without providing personal data for these purposes, it is impossible to ensure compliance with the obligations of "Aliaksandr Matsveyeu" to customers. 5.2 Processing cookies from websites operated by Aliaksandr Matsveyeu

If the subject has cookies enabled in his/her web browser, we process his/her behavior records from cookies placed on websites operated by Aliaksandr Matsveyeu for the purpose of ensuring better functioning of the Aliaksandr Matsveyeu website, conducting analysis and measurement to determine how our services are used, and for the purposes of Aliaksandr Matsveyeu online advertising.

6. WHAT ARE COOKIES AND WHAT TYPES OF COOKIES DO WE USE?

7. WHO WILL HAVE ACCESS TO YOUR PERSONAL DATA?

Aliaksandr Matsveye uses professional and specialized services of other organizations to fulfill its contractual obligations and commitments. If these providers process personal data transferred from Aliaksandr Matsveyeu, they have the status of personal data processors and process personal data only within the framework of Aliaksandr Matsveyeu's instructions and may not use it in any other way

We carefully select our partners to whom we entrust your data and who are able to ensure such technical and organizational security of your data that there is no unauthorized or accidental access to your data or other misuse of it. The protection of your data is our priority. All our partners are bound by confidentiality obligations and cannot use the provided data for any purposes other than those for which we provided it to them.

Third parties who may have access to your personal data are:

1) persons to whom we provide data for the purpose of analyzing traffic to our websites;
2) persons providing us with technical operation of certain services or operators of the technologies we use for our services;
3) persons delivering purchased goods, printed advertising materials or gifts to you as part of marketing activities;
4) persons who ensure sufficient security and integrity of our services and websites for us and regularly check this security;

6) business partners or sponsors involved in the organization of our events;

Under certain, strictly defined conditions, we are then obliged to transfer some of your personal data on the basis of applicable law, for example to the Czech Police or other law enforcement agencies, including specialized departments (UOOZ, customs administration, etc.) and other state authorities.

8. HOW LONG DO WE PROCESS YOUR DATA?

We will process your data for the entire period of your use of our services (i.e. the duration of the contractual relationship between us), and then on the basis of your consent for a further 24 months, unless your consent to the processing of personal data is revoked by you.

However, we would like to inform you here that personal data that is necessary for the proper provision of the products you have ordered or for the fulfilment of all our obligations, regardless of whether these obligations arise from a contract between us or from generally binding legal provisions, we must process, regardless of your consent, for the period specified by or in accordance with the relevant legal provisions, even after a possible withdrawal of your consent.

9. CAN WE PROCESS YOUR PERSONAL DATA WITHOUT YOUR CONSENT?

Yes, we can process your personal data without your consent, but only for the purposes of:

a) provision of the product (performance of the contract concluded between you and Aliaksandr Matsveyeu);

b) compliance with legal obligations arising for us from generally binding legal provisions;

c) processing that is necessary for the purposes of our legitimate interests (e.g. direct marketing, ensuring the security of our websites).

The possibility and lawfulness of such processing directly results from applicable law and your consent for such processing is not required.

10. ON WHAT BASIS CAN WE PROCESS YOUR PERSONAL DATA?

As already mentioned, we may process your personal data on the basis of your consent, but also, for example, on the basis of our legitimate interest (in particular processing for direct marketing purposes) or for the performance of a contract concluded between us, to the extent that the personal data is necessary for such performance. Last but not least, the reason why we may process your personal data even without your consent is to fulfill our legal obligations. For what specific purposes we carry out individual processing of your personal data, we indicate above.

11. HOW IS MY PERSONAL DATA PROTECTED?

All personal information you provide to us is protected by standard procedures and technologies. However, it is objectively impossible to fully guarantee the security of your personal data. Therefore, we cannot even guarantee 100% that the personal data provided will not be accessed by third parties, copied, published, modified or destroyed by breaching our security measures

However, in this context, we assure you that we regularly check the system for vulnerabilities and attacks and use security measures that, if possible, prevent unauthorized access to your personal data and provide sufficient security given the current state of technology. The security measures taken are then regularly updated.

To better protect your personal data, access to this data is password protected, and sensitive data is encrypted when transferred between your browser and our website.

However, we cannot fully ensure the security of your data without your help and responsible behavior. The withdrawal of consent does not affect the possibility of continuing to process your personal data on the basis of your consent, which was given before its withdrawal. Withdrawal of consent also does not affect the processing of personal data that we process on legal grounds other than consent (i.e. in particular if the processing is necessary for the performance of a contract, a legal obligation or for other reasons specified in the applicable law).

13. AM I OBLIGED TO PROVIDE MY PERSONAL INFORMATION? WHAT IF I DO NOT PROVIDE PERSONAL INFORMATION?

You provide us with your personal data voluntarily (however, for some services, the transfer of some personal data is necessary to make the service available, i.e. if you do not provide it to us, you will not be allowed to use this service).

Processing your personal data, often only in an anonymous form, without even being able to identify you as a specific user, allows us to provide you with our products and continuously improve and develop new ones. If you do not give or withdraw your consent, we will no longer be able to provide you with the full range of our products. Of course, you are not responsible for using our free services.

14. WHAT ARE ALL YOUR RIGHTS IN RELATION TO PERSONAL DATA PROTECTION?

In particular, you have the following rights in relation to your personal data:

9) Right to withdraw your consent to the processing of personal data at any time;

10) Right to be informed of a personal data breach in certain cases;

11) other rights provided by the Data Protection Act and the GDPR after its entry into force.

15. WHAT DOES IT MEAN THAT YOU HAVE THE RIGHT TO OBJECT?

If you no longer wish to receive from us from time to time any business communications or other information about new products in our product portfolio, you have the opportunity to object to the further processing of your personal data for direct marketing purposes. If you do so, we will no longer process your data for this purpose and will no longer send you further business communications and newsletters.
